1. Use and Condition of the Vehicle:


1.1 You will receive the vehicle in perfect working condition, with full documentation, tyres in good condition and accessories, including mobile phone holder, helmets, boot and lock.


1.2 It is your responsibility to keep and drive the vehicle in compliance with all the rules of the Highway Code. Any damage not indicated in the initial contract will be attributable to the owner of the vehicle.


1.3 It is forbidden to make any modifications to the technical characteristics, equipment, tools and/or accessories of the vehicle.


1.4 Only the contract holder, identified and accepted by LENACORP S.L., with a minimum of 1 year’s experience in driving is allowed to drive the vehicle. with a minimum experience of 1 year on scooters or 125cc motorbikes.


1.5 It is expressly forbidden to use the vehicle to transport people or goods for remuneration. In the event of improper use or use for such purposes, the Hirer must compensate the Rental Firm with 25 euro cents per kilometre travelled.


1.6 The use is limited to the east of Almeria and asphalted roads. It is forbidden to use it to commit illegal acts or to damage the image of the rental company, as well as to use it on racing circuits, unpaved roads, sand or rocks.


1.7 It is not permitted to use the vehicle for driving practice, to transport toxic, flammable or dangerous substances in general, or substances that violate current legislation, or to transport it on board any type of ship, train, lorry or aircraft. It is expressly forbidden to move the vehicle to any place that exceeds 25km from the point of delivery, and the hirer shall be responsible for all costs arising therefrom.


2. Price, Duration and Extension of the Rental:


2.1 The rental price is set according to the General Tariff in force and the initial agreement with the Hirer, including applicable insurance and taxes.


2.2 No cash deposit is accepted. The deposit of 200€ is blocked on your credit card and will be automatically released upon return of the vehicle, subject to inspection, the release of the deposit may take 2 to 4 weeks depending on the conditions agreed between the customer and his bank.


2.3 The return of the vehicle must take place at the agreed date, time and place. Any extension must be authorised in advance and paid for in advance. Returning the vehicle to a different location than originally agreed will incur an additional charge of €50. It is essential to present a copy of the contract and hand over the keys of the vehicle for any change or return. In case of late return of the vehicle, a fine of 50€ will be imposed. In addition, the prices corresponding to the extra days of rental will be charged. It is important to comply with the agreed deadlines to avoid any penalties.

 

3. Payments:


3.1 Payments must be made by credit card. Fines and penalties for traffic offences will be the responsibility of the client and will be charged to their card, a charge of 30€ will be made to the client for the corresponding administrative procedures.


3.2 LENACORP S.L. reserves the right to modify the rates at any time.


3.3 In the event that an employee of LENACORP S.L. has to travel to a municipal depot to recover a vehicle withdrawn due to the Client’s responsibility, an additional fee of €50 will be applied. In addition, the Client will be responsible for the payment of any fines imposed by the local authorities, which will be charged directly to the registered credit card.


3.4 The Client shall be responsible for any damage caused to third parties or to LENACORP S.L.


4. Insurance and Damages:


4.1 The price includes compulsory civil liability insurance. It does not cover theft, loss or damage to the vehicle itself or accessories. The client is fully responsible for any loss or damage to his belongings, goods or personal objects transported in the vehicle, whether due to vandalism or traffic accident.


4.2 The customer must pay €500 in the event of theft of the vehicle. Optional comprehensive insurance without excess is available, please consult rates.


4.3 Damage to accessories and extras are not covered and will be charged according to the General Tariff in force.


5. Assistance:


5.1 In case of breakdown or accident, the Hirer must contact the Rental Firm on the emergency telephone number given in the particular conditions. The Rental Firm is not responsible for any towing service or roadside assistance contracted directly by the Hirer. The roadside assistance is limited to the hours of 8:00 to 23:00 hours and the costs arising from assistance outside these hours will be borne by the customer. Free roadside assistance is limited to mechanical breakdowns not caused by the customer. If roadside assistance is requested without an actual breakdown, a charge of €100 will be made, as in the case of a breakdown caused by driver negligence, with the cost of the repair to be borne by the driver. If the breakdown is not caused by the driver, the vehicle will be replaced by another vehicle, subject to availability. In the event of non-availability, the amount of the unused rental period will be refunded. The repair of the tyres is always at the Hirer’s expense, who must immediately replace them with others of the same characteristics, make and model.


5.2 The roadside assistance service is included in the rental price and covers a distance of up to 65 km from Mojácar. For assistance outside this radius, the cost will be borne by the client. It is important to note that the renter must remain with the vehicle until the tow truck arrives to take it back to our premises.


5.3 In the event of improper use of the roadside assistance service, loss or breakage of keys or helmets, lack of fuel or inadequate refuelling, rescue of vehicles in places not suitable for driving, or any other error or negligence on the part of the client, an additional charge of €150 will be applied.


5.4 We do not offer replacement vehicles in the event of breakdown due to misuse or accident.
5.5 In situations of breakdown or accident, the renter is not entitled to additional rental hours or days. Furthermore, costs related to taxis or other means of transport used to return to our premises or to the client’s place of residence will not be reimbursed, as the hirer must use the 24-hour roadside assistance service, the contact number of which can be found in the rental contract.


6. Maintenance and repairs:


6.1 The Hirer is not authorised to order repairs to the vehicle without the express authorisation of LENACORP S.L, confirmed in writing.
6.2 It is the client’s responsibility to stop the vehicle if any anomaly is detected in its operation. Otherwise, the client will be responsible for the costs of repairs. The hirer must contact LENACORP S.L. or our roadside assistance company to report any mechanical problems.


6.3 For monthly, weekly or daily rentals, the lessee must take the vehicle to our workshop for mechanical checks once the number of kilometres indicated on the sticker located on the handlebars or under the seat has been reached. If the sticker has been removed due to weather conditions, the customer must contact our company to have the sticker replaced. Failure to comply with this clause will result in a penalty of €50 and will make the renter liable for any damage caused due to the lack of servicing. An appointment is required to be made by telephone 200 km in advance before reaching the number of kilometres indicated on the sticker. In the event that LENACORP S.L. considers it necessary to change the vehicle for any reason, the change will be made for another vehicle of similar characteristics according to availability.


6.3.1 During servicing or mechanical repairs, the Hirer is not entitled to a replacement vehicle.


7. Fuel:


7.1 The Hirer is responsible for the cost of fuel consumed during the rental period of the vehicle.


7.2 The Hirer must refuel the vehicle with the correct type of fuel. Otherwise, the Hirer is liable for the costs for the removal and/or repair of damage caused to the vehicle due to the use of unsuitable fuel.


7.3 The Hirer undertakes to return the vehicle with the same level of fuel as stated in the contract on the day of departure. If this is not the case, the necessary litres to reach this level will be invoiced, together with an additional charge for the refuelling service of €15.

8. Accidents:


8.1 The lessee expressly declares that he/she uses the rented vehicle under his/her entire responsibility, both while driving and during parking or custody. LENACORP S.L. accepts no liability, under any circumstances, for any personal, material or economic damage suffered by the Hirer, accompanying persons, third parties or their property as a direct or indirect consequence of an accident, fall, improper use of the vehicle or non-compliance with current traffic regulations. Likewise, the Hirer assumes all civil, criminal or administrative liability arising from the use of the vehicle during the rental period.


8.2 In the event of an accident with the vehicle, the Hirer must present the accident report form (blue form found inside the vehicle seat together with the other documents) within a maximum period of 48 hours from the date of the accident, duly completed at the location indicated by the LENACORP S.L. team. In any case, this process must be completed before the end of the vehicle rental period. Incomplete or illegible incident reports will not be accepted, and in the event that this occurs, the Client will be responsible for payment of the damages suffered by the LENACORP S.L. vehicle.


8.3 If the Hirer fails to provide LENACORP S.L. with the accident declaration form, a minimum charge of €50 will be applied, regardless of the value of the damage to the vehicle at the time of its return. In all cases, the Hirer’s deposit will be retained until the responsibility for the accident is clarified and, therefore, who will be liable for the damage to the LENACORP S.L. vehicle.
8.4 If the vehicle is not suitable for driving after an accident, LENACORP S.L. will retain the vehicle until the expert’s report is completed. In this situation, the customer is not entitled to a replacement vehicle.


8.5 It is strictly forbidden to carry out repairs, maintenance or to take our motorbikes to another workshop. For any repair, breakdown or maintenance, the vehicle must be taken to the garage indicated by the LENACORP S.L. team.

 

9. Modifications to the rental contract:


9.1 These general conditions and the other clauses of the rental contract may only be modified by a written agreement signed by both parties.


10. Protection of personal data:


10.1 In compliance with current legislation on data protection, LENACORP S.L. guarantees the confidentiality and security of the personal data provided in this contract. These data are necessary for the provision of the agreed service, as well as to offer and contract other products and services of our company.


10.2 The hirer authorises the automated processing of his personal data for the purpose of carrying out the contracted service and for future offers and contracts. Furthermore, the hirer is informed of his right to access, rectify and, if necessary, cancel his personal data by e-mail to [email protected]. Furthermore, the hirer gives his consent for LENACORP S.L. to transfer his data to companies of the group, franchisees or other entities with which our company establishes collaboration agreements to improve the provision of the vehicle rental service, respecting Spanish legislation on the protection of personal data.


11. Applicable law and jurisdiction


11.1 This contract shall be governed by and construed in accordance with Spanish law.


11.2 Any dispute arising from this contract between LENACORP S.L. and the lessee shall be subject to the jurisdiction of the courts and tribunals of Vera, to which both parties submit.

 

12. Deposit:


12.1 When renting the scooter, the renter must pay a deposit of 200€. This is compulsory and the scooter may not be hired without this, regardless of whether or not a reservation has been made in advance. If the renter refuses to pay the deposit, the scooter will not be hired and the reservation will not be refunded.


12.2 The deposit is payable by Visa or MasterCard credit card. American Express or Maestro cards are not permitted, nor is cash payment. If damage to the vehicle is detected, the corresponding amount will be deducted from the deposit. If the damage exceeds €200, it will be charged directly from the bank card provided in the contract, which is signed after having read and accepted our terms and conditions.


12.3 Deposits made with bank cards are referred to as ‘pre-authorisation’, which implies a blocking of the corresponding amount.


12.4 The blocking period is approximately 2 to 4 weeks, depending on the bank. If the Hirer’s bank is outside Spain, this period may be delayed.


12.5 The refund of the deposit is done automatically by the banking system, as it is only a deduction from the Hirer’s account. LENACORP S.L. does not intervene in the unblocking of these pre-authorisation operations, it being the responsibility of the Hirer’s bank to carry out this procedure.


13. Reservation cancellation policy


13.1 If the cancellation is made with a notice of more than 48 hours, 100% of the amount paid for the reservation will be refunded.


13.2 Cancellations will not be accepted for cancellations with less than 48 hours notice.


13.3 In case of cancellation without notice, no refund will be made.


13.4 LENACORP S.L. is not responsible for weather conditions, so no refund will be made, even partially, due to bad weather or other adverse weather conditions.


13.5 We do not guarantee the delivery of the scooters to your home or hotel if reservations are not made at least 24 hours before the date and time of arrival.


13.6 The company reserves the right to cancel the booking if the driver does not meet the necessary requirements to drive, such as being at least 21 years of age and presenting the required documentation, including ID card, passport, NIE, valid driving licence and bank credit card. In addition, if the renter does not have sufficient experience to drive our scooters, this will be sufficient grounds for cancellation.


13.7 If the hirer does not show up within 15 minutes at the agreed location for the delivery of the vehicle, this will be considered as a reason for cancellation of the reservation, and the total amount of the reservation minus one day’s rental will be refunded.


13.8 The company LENACORP S.L. reserves the right to cancel the reservation at the same time if the renter is not fit to drive or his behaviour presents a danger to others or to himself. If he is aggressive towards our staff such as insults, coercion, verbal or physical aggression, or if he is under substances that are not suitable for driving, these will be sufficient grounds to cancel the reservation, even if it has been paid and reserved, no refund of the rental or delivery service will be made.


13.9 We reserve the right not to rent vehicles to customers who violate or are suspected of violating any of the conditions or obligations set out in this document.


14. Early return

 

14.1 In case of early return of the rented vehicle, LENACORP S.L. will not apply any penalty to the contract holder. Likewise, no reimbursement will be made for unused days, as well as for the extras contracted for the unused days.

 

15. GPS Location


15.1 Some of our vehicles are equipped with a GPS tracking system, Airtag or other fleet control devices.


15.2 The GPS tracker only collects information about the movement and location of the vehicle.


15.3 It is strictly forbidden to disconnect the GPS tracker as a means of locating vehicles to prevent theft and for no other purpose.


15.4 In case of unplugging or disconnecting the GPS tracker you will be charged a replacement fee of 60€.

 

16. Mileage Limits and Penalties


Mileage Limit: The motorbike rental includes a maximum limit of [100] kilometres per day. Excess kilometres will be penalised according to the following ranges:

 

  • From 1 to 50 km extra: 10€.
  • 51 to 100 km extra: 20€.
  • More than 100 km extra: 30€


17. Repatriation cost


In the event that the motorbike must be repatriated as a result of misuse, accident resulting from the lessee’s negligence or abandonment of the vehicle outside the authorised areas, all costs incurred for the recovery of the vehicle – including, but not limited to, towing services, transport and assistance – shall be borne in full by the lessee.

18. Equipment and Accessory Liability

All motorbikes rented by LENACORP S.L. are equipped with a mobile phone holder and are delivered with two approved helmets. The lessee undertakes to make proper use of these accessories and to keep them in good condition during the rental period.


In case of loss, damage or non-return of any of the helmets, a penalty of 80 euros per unit will be applied. In case of loss or damage of the mobile phone holder, a penalty of 20 euros will be applied. These amounts will be charged directly to the hirer using the payment method provided when formalising the contract.
